I'm from ASIO. We'd like to talk to you." The recipient of the call is given a time and place to meet, usually a cafe, shopping centre, hotel or office hired for the purpose. He is told to come alone and not tell anyone. In this case, the subject is an Indonesian-born Australian citizen who has lived here for nearly 30 years. He is a university-educated Christian with no interest in politics. He has been targeted because ASIO has learned that he recently met up with an old friend from 25 years ago in Jakarta, an Australian who is on ASIO's terror watch list. Wayan (who was too nervous to give his real name) is so worried he rings a journalist: "I'm telling you in case I disappear and am never seen again." He thinks he has been under surveillance, having noticed a man sitting in a car outside his home for weeks. When he arrives at the coffee shop, Wayan is met by two agents who give him their operational pseudonyms. Then the interrogation begins. Why did he come to Australia? What did he think of the Cronulla riots? What does he think of terrorism? How often does he go back to Indonesia? What are his views on Indonesian politics? What does he think of Islam? The agents are "quite nice and courteous" but "gung-ho", Wayan recalls. "They told me not to tell anyone because they don't want people to get suspicious of me, but the only people who suspect me is them!" To Wayan's relief the meeting goes smoothly and the agents leave, apparently satisfied. But for many people who bob up on ASIO's radar, the consequences of such an encounter can be dire, ranging from cancellation of their passports to forced eviction from the country, the fate awaiting Iranian-born Sydney cleric Mansour Leghaei, who faces deportation after being judged by ASIO to be a threat to national security. Like Leghaei, the targets of ASIO's attention may never know what they're accused of, have no right to see the evidence against them and have a strictly limited right of appeal because of the demands of "national security". While most Australians probably welcome ASIO's vigilance against terrorism, for its targets it can seem there are no clear rules, no transparency, no accountability and, often, no justice. For Leghaei, the call from ASIO came in 1995, a year after he arrived in Australia on a temporary business visa and not long after he returned to Sydney from a holiday in Iran. He was carrying a $10,000 cash donation from the Islamic Propagation Centre in Tehran, which funds Shia centres and mosques abroad. The cash was for a new Islamic centre in Melbourne. Leghaei was asked about the money on arrival and says the authorities seemed satisfied. He was also carrying a book of notes copied from a religious text at Tehran University that contained underlined references to concepts such as jihad and martyrdom. The notebook was apparently photocopied by Customs and passed on to ASIO. A month later, Leghaei was summoned by ASIO for the first of eight interviews over four years. He was questioned on his politics and religious beliefs, the Iranian money and the notebook. A source familiar with the interview says his interrogators were "red hot" about the references to jihad. The following year when Leghaei applied for permanent residency it was refused after an adverse security assessment by ASIO deemed him a national security risk. As a non-citizen he was not entitled to be told the reasons and had no right to seek a review. Leghaei's supporters were stunned. The only fluent English-speaking Iranian cleric in Australia, he is widely regarded as a moderate and champion of inter-faith dialogue. His friend David Smith, an Anglican priest, says: "Having worked alongside the sheik for seven years, it's inconceivable that he is in any way trying to undermine Australia's security because every step of the way he has been working towards integration, understanding, mutual respect and breaking down barriers." Leghaei's local MP Robert McClelland - who is Attorney-General and thus responsible for ASIO - wrote a reference at the time saying he was "most surprised" at the adverse assessment and describing Leghaei as an "erudite man, conciliatory in tone and demeanour" and "an asset to the Australian community". However, some among Leghaei's congregation were unhappy about his Iranian connections. In 1999, an anonymous letter sent to the immigration minister claimed the cleric was a security threat because he was "funded by the Iranian government and represented the Iranian ayatollahs". That concern was likely to have been exacerbated two months later when, at the opening of the new Imam Husain Islamic Centre at Earlwood, Leghaei was given a cheque for $32,000 by the Iranian ambassador, a donation from the Iranian government to help pay the mortgage on the land. At the time the Iranian government was headed by president Mohammad Khatami, who was regarded as a pro-Western reformer. When Leghaei appealed to the Federal Court in 2002, ASIO's lawyers belatedly produced as evidence against him an English translation of the notebook found in his luggage seven years earlier. Leghaei's lawyers argued the translation was flawed and misleading. Leghaei says key words were translated wrongly and entire paragraphs were added by the translator, including inflammatory lines about "infidels". ASIO eventually admitted its translation was wrong and was ordered to pay one-third of Leghaei's costs. However, the agency issued a fresh assessment, asserting anew that Leghaei was a "direct risk" to national security. He was accused of "acts of foreign interference", without being told what those acts were. ASIO argued in court it would be prejudicial to national security to reveal the confidential information it relied on. Leghaei was prevented from hearing the evidence against him. Judge Rodney Madgwick noted that Leghaei had resided lawfully in Australia for more than a decade, "appears to have performed valuable community services" and his family's deportation "may well cause hardship to utterly blameless Australian citizens". However, the judge said the court had no jurisdiction to challenge the "merits and validity of ASIO's assessment" but could decide only whether he had been afforded procedural fairness. He found Leghaei had been treated as fairly as possible within the constraints of national security, under which, he said, "procedural fairness is reduced, in practical terms, to nothingness". The key part of his judgment, dealing with the evidence, was kept secret. Leghaei's experience is not unique. Since 2001, more than 40 Australians have had their passports cancelled after being assessed as a threat to national security. They can appeal to the Administrative Appeals Tribunal but neither the appellant nor the AAT has a right to see the material on which the assessment is based, and both the appellant and their lawyer can be excluded from the court while the evidence is heard. One such Australian is Sydney man Mamdouh Habib, who has been trying to get his passport back since 2005, when he was released without charge and returned to Australia after three years in Guantanamo Bay. Habib had been arrested in Pakistan in 2001, handed over to the CIA, rendered to Egypt, detained and tortured there for seven months before being incarcerated in the US military prison in Cuba. ASIO still assesses Habib as a threat to national security and bars him from travelling abroad. Habib received the latest of many calls from ASIO in January. "Hello, it's Mike from ASIO. We want to talk to you about your passport." The meeting took place at an office in Sydney's Parramatta. Habib was allowed to take his wife and son but was asked not to tell anyone else, an undertaking he refused to give. He was told the ASIO agents were interested only in events since his return to Australia, in particular his political views. Habib's politics are no secret. He stood for parliament as an independent in the 2007 NSW election. He has written a book, starred in a play, given countless media interviews and ventilated his views in a string of court cases, including a damages claim against the commonwealth that is before the Federal Court. The questioning proceeded along familiar lines: How would you describe your political and religious views? Your views on using violence to achieve political or religious ends? What's your opinion of the US-led invasions of Afghanistan and Iraq, and Australia's support for the wars? What do you think of Osama bin Laden? Habib has been asked these questions many times before and soon became angry. The interview descended into a shouting match and ended with Mike from ASIO threatening to call the police. Habib left, presumably no closer to having his passport returned. Susan Harris Rimmer, of Australian Lawyers for Human Rights, believes ASIO's security assessment regime may be in breach of the International Convention on Civil and Political Rights, which guarantees the rights to travel and a fair hearing. "Those affected see the removal of their passport as an attack on their citizenship, a symbolic method of punishment and control that does not rely on rigorous testing by the courts," she says. Julian Burnside QC has described the right to appeal as "little more than a charade". Leghaei exhausted his final legal avenue last month, when the Migration Review Tribunal examined his case. He pointed out during the hearing that he was last interviewed by ASIO 11 years ago and has had no contact with it since then. The MRT was not given a copy of the ASIO assessment and ruled it had "no alternative" but to uphold the minister's decision to deport Leghaei. "While the tribunal is sympathetic to the primary applicant's predicament, it does not have the power to go behind or to examine the validity of the ASIO assessment," it said. Smith appeared as a witness at the MRT hearing. "We thought it was a genuine hearing to reassess his case, but it wasn't that at all, it was just a completely meaningless rubber stamp," he says. "I think the fact [ASIO is] not accountable to anyone . . . should be deeply concerning to everyone in this country. Anyone who is not accountable and uses the spectre of terrorism to justify anything they want to do is very disturbing. Big Brother has come of age." The expulsion came after the British intelligence concluded there was "compelling evidence" that the fake UK passports used by the Dubai hit squad were created by Mossad, the Israeli special operations unit. "Such misuse of British passports is intolerable," the Foreign Secretary David Miliband told Parliament. "The fact that this was done by a country which is a friend, with significant diplomatic, cultural, business and personal ties to the UK, only adds insult to injury." In an unusual move last night, the Foreign Office also updated its travel advice for Israel, warning would-be visitors of the perils of passport cloning. "We recommend that you only hand your passport over to third parties including Israeli officials when absolutely necessary," the travel bulletin said. In Israel, the official response to London's action was notably terse. "The relationship between Britain and Israel is mutually important," the foreign ministry said. "We therefore regret the British decision." But in other quarters there was undisguised fury. "I think [the] British are behaving hypocritically. Who are they to judge us on the war on terror?" said Aryeh Eldad of Israel's National Religious Party. The row marked another chapter of friction between Israel and its Western allies. Relations with Washington were reported to be at a 35-year low, following the Israeli government's announcement of 1,600 new homes in East Jerusalem while US Vice-President Joe Biden was visiting. The fact that today's meeting at the White House between Prime Minister Benjamin Netanyahu and President Barack Obama was held behind closed doors was interpreted as another sign that tempers have not fully calmed. More importantly why isn't Australia taking any action similar or otherwise against Israel for letting its intelligence agency use fake Australian passports amongst other countries? In fact shouldn't government authorities be issuing travel advice warnings to Australians travelling to Israel?? At least Australians travelling to Israel should all be fore-warned to take extreme care & be made aware of the possibility that their Australian Passports might get misused! This is exactly what happened in this case where British passports were forged after being taken temporarily from uninvolved & unsuspecting Britons as they passed through border entry/exit points. University of Sydney Professor in Public Health Simon Chapman points to recent Dutch research which identified 185 different industrial uses of a pig - including the use of its haemoglobin in cigarette filters. Prof Chapman said the research offered an insight into the otherwise secretive world of cigarette manufacture, and it was likely to raise concerns for devout Muslims and Jews. The Dutch research found pig haemoglobin - a blood protein - was being used to make cigarette filters more effective at trapping harmful chemicals before they could enter a smoker's lungs.
